Out of Touch - ACCC v Mazda Australia [2023] FCFCA 45

Check out my recent video presentation entitled "Out of Touch - ACCC v Mazda Australia [2023] FCFCA 45" in which I discuss the recent Full Federal Court decision, which determined Mazda's appeal on the findings of false, misleading and deceptive conduct and the ACCC's appeal of the rejection of its unconscionable conduct case. I critique the out of touch approach taken by the majority of Mortimer and Halley JJ in interpreting statutory unconscionability under the Australian Consumer Law and compare it to the preferable approach taken by Lee J in his dissent.
