Video Case Note - All at sea : Carnival plc v Karpik (The Ruby Princess)

Check out my recent Video Case Note entitled "All at sea : Carnival plc v Karpik (The Ruby Princess) [2022] FCAFC 149" which looks at the recent Full Federal Court decision on whether US passengers can remain part of the Australian class action. I seek to make sense of what is a very unsatisfactory and inconsistent judgement; look at the potential problems concerning the extraterritorial effect of the unfair contract term laws (interaction of section 5(1)(g) of the Competition and Consumer Act and section 23 of the Australian Consumer Law); and examine Derrington J's highly negative and gratuitous criticisms of Australian class action laws.
