Check out my video discussion of the judgments in the Employsure misleading and deceptive conduct cases. The saga begins with Justice Griffith's first instance liability decision in ACCC v Employsure Pty Ltd [2020] FCA 1409 which was overturned by the Full Federal Court in ACCC v Employsure Pty Ltd [2021] FCAFC 142 per Rares, Murphy, Abraham JJ. The next instalment was Griffith J's first instance penalty and costs decisions in ACCC v Employsure Pty Ltd (No 2) [2021] FCA 1488 and ACCC v Employsure Pty Ltd (No 3) [2022] FCA 3 which were also appealed and overturned by the Full Federal Court in ACCC v Employsure Pty Ltd [2023] FCAFC 5 per Rares, Stewart and Abraham JJ. There is heaps of interesting and important law in the two appeal judgments and a ridiculously large number of mistakes and errors in the three first instance decisions.
Run time 45 mins (a bit on the long side, there were five judgements which I had to cover, after all!)
